New Medicare MSA Guide. In a recent updated manual, Medicare has strengthened their position about reporting and approving MSAs, specifically stating in Section 4.3, The Use of Non-CMS-Approved Products to Address Future Medical Care, that CMS may refuse to pay for any medical treatment for a workers’ compensation claimant whose settlement was not reviewed by Medicare until the claimant spends the entire amount of the settlement on medical care.
